Any machine that is in service within the EEC (European Economic Area) must comply with the required health and safety regulations.

 

If the start up has been carried out as of  January 1,  1995 (date included), it is mandatory that it complies with this Directive 2006/42/CE, on the contrary if the start up dates before January 1, 1995 only requires that a “MACHINE ADEQUACY”, be made, which in compliance with Real Decree 1215/97.

 
The RD 1215/97, of July 18, which establishes the minimum health and safety provisions for the use by workers of work teams, is established in the framework of Law 31/1995, of November 8 , of “Labour Risk Prevention“, the minimum health and safety provisions for the use of equipment used by workers at work, as well as the provisions of Real Decree 39/1997, of January 17, which establishes approves the Regulation of Prevention Services. 
 

 

According to article 3 of this RD 1215/97, the employer must take the necessary measures so that the work teams that are made available to the workers are adequate to the work that must be performed and conveniently adapted to it, in order to guarantee the safety and health of workers when using such work equipment.

 

The RD 1215/97 in its Annex II, clearly sets out the Provisions regarding the use of work equipment, expressing in point 1.3 the change in intended use, “The work equipment may only be used in a way or in operations or in conditions not considered by the manufacturer if an assessment of the risks that this would entail has previously been carried out and the relevant measures have been taken for their elimination or control. ”
